AI has become one of the most powerful forces reshaping human civilization. AI’s influence is expanding in every field, from healthcare to banking, media, and governance. Nevertheless, its connection with the legal profession and justice remains among the least explored in Pakistan. The country’s legal framework is at a crossroads with monumental backlogs of cases, archaic procedures, and outdated technology. AI can cause serious risks to privacy, ethics, and accountability while providing a historic opportunity to enhance access to justice, enhance transparency, and speed up judicial processes.
The legal sector and judicial framework of Pakistan, established on colonial-era statutes like the Civil Procedure Code of 1908 and the Criminal Procedure Code of 1898, struggles to keep pace with the needs of a society increasingly digitalizing. A chronically under-resourced judge-to-population ratio and over 2.3 million cases pending have long compromised the accessibility and efficiency of the court system. The need to use AI for technological integration is not just a luxury here; it is an urgent requirement.
Each stage of the legal process can be automated with AI. Smart legal databases can assist judges in their research, automated scheduling or case-management systems can reduce delays in procedures, and predictive analytics can identify case bottlenecks. Even basic apps can greatly improve access to justice, particularly in rural communities. Some examples are virtual assistants to assist litigants or electronic filing systems.
This route has already begun in several countries. The Indian Supreme Court introduced SUVAS, an AI-based judgment-tagging and translation technology bridging linguistic gaps. While the US employs AI technologies for risk assessment and punishment analysis, the UK has established online courts for hearing disputes. Pakistan, however, is only yet engaged in a limited number of pilot initiatives concerning digital case management and e-filing. The issue is not a lack of vision but rather a failure to develop a sound policy framework and institutional readiness to implement AI appropriately.
AI can transform Pakistan’s courts significantly into efficient, transparent, and citizen-centric institutions if used wisely. The UAE and China have already moved towards smart court models that indicate how AI-assisted case tracking, real-time transcription, and automated scheduling can reduce the administrative burden.
Such systems can begin at the district levels in Pakistan. There are many benefits of using generative AI in the legal field. Judges would be able to manage workload more easily, spot inconsistent judgments, and ensure uniform application of the law. Using AI-powered dashboards can relieve attorneys’ time for focusing on strategic litigation and lobbying on behalf of clients by automating routine tasks such as review of contracts, research, and drafting. Virtual legal clerks would be an accessible tool for citizens, especially in rural or underdeveloped regions, for procedural justice.
AI’s introduction to the legal system, however, cannot be unconditional, irrespective of its massive potential. Unlike business or entertainment, law involves human life, freedom, and rights. Ethics, justice, and transparency, thus, have to be the pillars of AI’s use in the legal system.
While it promises efficiency, the same technology can risk fundamental freedoms. The dark side of AI has already been witnessed in Pakistan in the form of deepfakes, voice cloning, and massive data leaks. Of the over 11,000 cyber complaints filed in 2023, over 1,200, as per the Federal Investigation Agency, were regarding deepfake content, which mainly targeted women. The exploitation of AI to produce pornography pictures and sounds has led victims to endure the most atrocious emotional, financial, and reputational damages.
Sadly, Pakistan’s existing judicial infrastructure is not equipped to deal with these concerns. The country’s key cyber law, the Prevention of Electronic Crimes Act (PECA) 2016, remains ambiguous on dealing with AI-generated content, algorithmic accountability, and data protection. Its ambiguous definitions of “fake” or “modified” content deprive victims of harassment by AI of adequate recourse.
In addition, several data dumps have exposed residents’ personal data to misuse, such as those allegedly involving banks and even the National Database and Registration Authority (NADRA). These incidents underscore Pakistan’s poor system of data governance, along with the absence of a dedicated Data Protection Authority with a mandate to oversee and implement laws.
Overseas experiences teach us valuable lessons. In America, risk assessments of AI systems are mandated by the Algorithmic Accountability Act, compelling companies to take into account potential social costs. Personal data cannot be processed without prior express consent under the UK’s Data Protection Act 2018 and General Data Protection Regulation (GDPR). Breaches of these statutes are punishable by hefty fines. Even the emerging countries, including India, have started to regulate AI by adopting ethical frameworks that place the greatest importance on human control and transparency.
Pakistan may apply these models to develop its own hybrid system that reconciles technology advancement with the constitutional guarantees of due process, privacy, and dignity. Future legislation has to ensure that AI applications in administrative or judicial contexts are transparent, understandable, and accessible to court examination.
